1. Who we are
Sway This Way is operated by Amory Life LLC, a Florida limited liability company with a registered address at 7901 4th St. N., STE 300, St. Petersburg, FL 33702, USA ("Sway This Way," "we," "us," or "our"). This Privacy Policy explains what personal information we collect through the Sway This Way website and apps (the "Service"), why we collect it, how it's used and shared, and the choices and rights available to you.
Sway This Way is an adults-only membership platform. By using the Service you confirm you are at least 18 years old and that participation in a sex-positive lifestyle community of this kind is legal where you live.
2. Information we collect
Information you give us directly
- Account information: email address, password (stored as a salted hash — we never store or can see your plaintext password), screen name.
- Profile information: date of birth, profile type (single or couple/group, and the sex of each person on the profile), a ZIP code, body and lifestyle details you choose to fill in (such as body type, ethnicity, relationship status, and similar fields you control field-by-field), a bio, and preference/interest tags describing what kind of connections you're looking for.
- Photos: any photo you upload to your profile.
- Messages: the content of messages you send to other members through the Service.
- Payment information: if you choose card verification (see our ID & Age Verification page), your payment is handled entirely by our payment processor, CCBill. We do not receive or store your full card number — CCBill provides us only a confirmation that a charge succeeded and a verification status.
- Communications with us: anything you send to support, moderation, or through the invite/waitlist forms.
Information collected automatically
- Usage data: pages and features you use, timestamps, and general activity needed to run features like presence ("online now") and moderation.
- Device and log data: IP address, browser type, and similar technical information standard web servers log.
- Location (ZIP-level only): the ZIP code on your profile is used to sort and search for nearby members. Your exact ZIP code and any distance figure are never shown to other members — only your city/region is visible to them. This is a deliberate design choice, not a default we might quietly change; see Your rights for how to remove it.
3. Sensitive information
Some information on Sway This Way is inherently sensitive — for example, sexual orientation and interest preferences, relationship structure, and anything you choose to share about your sexual health or testing status in your bio or in messages. We treat this category of information with extra care: it is never sold, we apply the visibility setting you choose to each field (Public, Connections Only, or Private), and specific data-privacy rules for this category are covered separately on our Sexual Health & Data page — read that page for details specific to sensitive health-adjacent data, including rights available to Washington State residents under state law.
4. How we use information
- To create and operate your account and profile, and to show you to (and match you with) other members according to your own visibility settings.
- To operate messaging, connections, and other member-to-member features.
- To verify eligibility (age self-attestation, and optional card verification) and to detect and prevent fraud, abuse, and policy violations.
- To respond to reports, moderate content, and enforce our Terms of Service.
- To send you service-related email (e.g., account, billing, and safety notices) through our email provider.
- To maintain and improve the reliability and security of the Service.
- To comply with legal obligations, including responding to lawful requests from law enforcement and, where required, reporting apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) as required by law.
We do not use your information to serve third-party advertising, and we do not sell your personal information.
5. How we share information
We share information only in these circumstances:
- With other members, as you direct. Anything you set to "Public" or "Connections Only" is visible accordingly. Fields set to "Private" are never shown to other members.
- With service providers who help us run the Service — currently our payment processor (CCBill) for billing and card verification, our hosting provider (Amazon Web Services), and our business email provider (Microsoft 365). Each only receives the information it needs to do its job, and each is bound by its own data-handling terms.
- For legal reasons — to comply with a subpoena, court order, or other legal process; to enforce our Terms of Service; to protect the rights, property, or safety of Sway This Way, our members, or the public; or as required by law (including mandatory CSAM reporting, described above).
- In a business transfer — if Sway This Way is ever involved in a merger, acquisition, or sale of assets, member information may be transferred as part of that transaction, subject to this policy (or a policy at least as protective, with notice to you).
We do not sell your personal information, and we do not share it with third parties for their own marketing purposes.
6. Cookies and analytics
We use strictly necessary cookies to keep you signed in and to keep the Service working correctly (for example, your session token).
7. Data retention
We keep your information for as long as your account is active, and for a reasonable period afterward to comply with legal obligations, resolve disputes, and enforce our agreements. Photos and content removed by you or by moderation are deleted from active use; some records (such as moderation history involving safety violations) may be retained longer where necessary for safety and legal compliance.
8. Your rights and choices
- Access and correction: you can view and edit most of your profile information directly in your account at any time.
- Deletion: you can request deletion of your account and associated data by contacting privacy@amorylife.com.
- Visibility controls: every sensitive profile field and preference tag has its own visibility setting (Public / Connections Only / Private) that you control.
- State privacy rights: depending on where you live, you may have additional rights — for example, California residents have rights under the CCPA/CPRA (to know, delete, correct, and opt out of the sale/sharing of personal information — noting again that we do not sell personal information), and Washington State residents have specific rights regarding "consumer health data" under the My Health My Data Act, described on our Sexual Health & Data page.
9. Security
We use industry-standard safeguards to protect your information, including encrypted connections (HTTPS/TLS) between your device and our servers, and salted password hashing so we never store your password in readable form. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
10. Children's privacy
Sway This Way is strictly for adults 18 and older. We do not knowingly collect information from anyone under 18. If we learn that an account belongs to someone under 18, we will terminate the account and delete the associated data, and will report as required by applicable law.
11. U.S.-only service
Sway This Way is currently offered to U.S. residents only.
12. Changes to this policy
We may update this Privacy Policy from time to time. If we make material changes, we'll notify members (for example, by email or an in-app notice) before the changes take effect. The "last updated" date at the top of this page always reflects the most recent version.
