1. Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you and Amory Life LLC ("Sway This Way," "we," "us"). By creating an account or otherwise using Sway This Way (the "Service"), you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

2. Eligibility

• You must be at least 18 years old to create an account or use the Service, with no exception.
• You must have the legal capacity to enter into a binding contract.
• You are responsible for confirming that use of an adult lifestyle/social platform of this kind is lawful in your jurisdiction.
• Each account must correspond to one real individual (or, for a couple/group profile, the specific real individuals actually on that profile) — no impersonation, no fictitious identities, and no account created on someone else's behalf without their knowledge and consent.
• You may not create an account if you have previously been banned from the Service, without our express written permission.
• Sway This Way is currently offered to U.S. residents only.

3. What this platform is — and isn't

Sway This Way is a social and matching platform for the consensual, adult lifestyle community. It exists to help members meet, connect, and communicate with other members who are interested in the same kind of connections. Sway This Way is not an escort service, an introduction service for hire, or a platform for arranging commercial sexual activity of any kind, and using it for that purpose is a material violation of these Terms — see the Code of Conduct below.

4. Your account

• You're responsible for keeping your password confidential and for all activity under your account.
• Notify us immediately at support@amorylife.com if you believe your account has been compromised.
• You may not sell, rent, lease, or transfer your account to anyone else.

5. Membership tiers and billing

Some features require payment, processed by our third-party payment processor, CCBill.

• Card verification and any paid tier renew automatically at the interval disclosed at checkout unless you cancel before the renewal date.
• You can cancel at any time through your account settings or by contacting support@amorylife.com; cancellation stops future charges but does not automatically refund the current billing period unless required by law or stated otherwise at checkout.
• All charges are billed by CCBill and will appear on your statement under CCBill's discreet billing descriptor, not the Sway This Way name.

6. Code of conduct

This is a community built on consent and mutual respect. The following are never allowed, and any violation may result in immediate suspension or termination without refund:

• No content involving minors, ever, in any form — including images, text, or roleplay. Sway This Way has zero tolerance for this and will report apparent child sexual abuse material to NCMEC and law enforcement as required by law.
• No non-consensual recording or sharing of any member's photos, messages, or identity — on or off the platform. What happens between consenting adults stays between consenting adults unless everyone involved agrees otherwise.
• No harassment, hate speech, threats, or discrimination against any member.
• No solicitation of commercial sexual activity, escorting, or prostitution — see Section 3.
• No posting of another real person's photo or identity without their knowledge and consent, including a partner or a person not present on the platform.
• No scraping, automated data collection, or reverse engineering of the Service.
• No impersonation of another person, member, or Sway This Way staff.
• No spam, solicitation for outside services, or advertising not authorized by us.

If you experience or witness a violation, please report it — reports can be made from any profile or message thread, or by emailing support@amorylife.com.

7. Content you post

You retain ownership of the photos, bio text, and other content you post. By posting it, you grant Sway This Way a limited, non-exclusive license to display it within the Service, consistent with the visibility setting you choose for it. You confirm that you have the right to post the content, and that everyone depicted in a photo you post has consented to that photo being shared on Sway This Way at the visibility level you've set. We may review, moderate, and remove content that violates these Terms.

8. Moderation and enforcement

We may investigate reports, review content, and suspend or terminate any account, at our discretion, for violating these Terms or for conduct we reasonably believe is harmful to another member or to the Service — with or without notice, and without refund of any prepaid fees, to the extent permitted by law.

9. Intellectual property

The Sway This Way name, logo, design, and software are owned by Amory Life LLC and may not be copied, used, or reproduced without our written permission.

10. Copyright (DMCA) notices

If you believe content on Sway This Way infringes your copyright, send a notice meeting the requirements of the Digital Millennium Copyright Act to dmca@amorylife.com.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT VERIFY THE IDENTITY, INTENTIONS, OR STATEMENTS OF ANY MEMBER BEYOND WHAT IS DESCRIBED IN OUR ID & AGE VERIFICATION PAGE, AND WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY MEMBER, ON OR OFF THE PLATFORM. YOU ARE SOLELY RESPONSIBLE FOR YOUR OWN SAFETY, DECISIONS, AND INTERACTIONS WITH OTHER MEMBERS, INCLUDING ANY IN-PERSON MEETING. WE STRONGLY ENCOURAGE MEETING IN PUBLIC FIRST, TELLING A TRUSTED FRIEND YOUR PLANS, AND FOLLOWING THE SAFER-SEX GUIDANCE ON OUR SEXUAL HEALTH PAGE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Amory Life LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR YOUR INTERACTIONS WITH OTHER MEMBERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

13. Indemnification

You agree to defend, indemnify, and hold harmless Amory Life LLC from any claim or demand, including reasonable attorneys' fees, arising out of your violation of these Terms, your content, or your interactions with other members.

14. Dispute resolution & arbitration

Please read this section carefully — it affects your legal rights. Except for small-claims-court-eligible disputes or claims for injunctive relief, you and Amory Life LLC agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, not in court, and not as a class action. You and we each waive any right to a jury trial and to participate in a class action or class arbitration.

15. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.

16. Termination

You may close your account at any time. We may suspend or terminate your account as described in Section 8. Sections that by their nature should survive termination (including Content licenses already granted, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution) will survive.

17. General terms

• Changes to these Terms: we may update these Terms from time to time; material changes will be communicated before they take effect.
• Severability: if any provision of these Terms is found unenforceable, the rest remain in effect.
• No waiver: our failure to enforce a provision is not a waiver of our right to do so later.
• Entire agreement: these Terms, together with the Privacy Policy and the ID & Age Verification and Sexual Health pages, are the entire agreement between you and us regarding the Service.
